PREAMBLE
These terms and conditions govern the sale of tickets:
– on the website: www.albret-tourisme.com and its subdomain: https://reservation.albret-tourisme.com
– at the Albret Tourist Office's tourist information centers (only affected by Articles 6 to 10) equipped with an online sales interface
These terms and conditions are systematically brought to the buyer’s attention and/or made available upon request to any buyer wishing to place an order. Consequently, placing such an order implies the buyer’s full and unconditional acceptance of these general terms and conditions of sale. Any specific terms and conditions applicable to the organizer will be brought to the buyer’s attention in the section describing the event.
The Albret Tourist Office reserves the right to adapt and/or modify these general terms and conditions of sale at any time. In this case, the GTC in force on the day of the order will apply.
Contractual relationships:
The information appearing on the website may be subject to changes, of which the customer will be informed in advance when placing their order. The customer acknowledges that they are able to enter into a contract under the terms and conditions described in the following terms and conditions of sale: they must be at least 18 years of age, legally capable of entering into a contract, and not under guardianship or trusteeship. Failing this, the Albret Tourist Office reserves the right to cancel the order.
1.1 The aforementioned online sales site, as well as the Nérac tourist information office, offer all existing rates.
1.2 Rates are quoted in euros, including all taxes. They include any rental fees but exclude processing fees (see Article 5).
1.3 Orders are payable in Euros only, regardless of their origin.
1.4 Only payments by check, cash, vacation check, Connect vacation check, bank transfer, or credit card are accepted. Only CARTE BLEUE, VISA, EUROCARD, and MASTERCARD cards are accepted.
1.5 The Albret Tourist Office accepts no responsibility for any complications or inability to make purchases resulting from the security procedures (3D Secure) specific to banks.
1.6 The resale of tickets is prohibited by law (law of June 27, 1919). Violators are subject to penalties (law of March 12, 2012).
Law of March 12, 2012:
Art. 313-6-2.- The act of selling, offering for sale, or displaying for sale or transfer, or providing the means for the sale or transfer of tickets to a sporting, cultural, or commercial event or live performance, on a regular basis and without the authorization of the producer, organizer, or owner of the rights to exploit that event or performance, is punishable by cultural or commercial event or a live performance, on a regular basis and without the authorization of the producer, organizer or owner of the exploitation rights for that event or performance, is punishable by a fine of €15,000. This penalty is increased to a fine of €30,000 in the event of a repeat offense.
"For the purposes of the first paragraph, any ticket, document, message, or code, regardless of its form or medium, certifying that the right to attend the event or performance has been obtained from the producer, organizer, or owner of the exploitation rights shall be considered as an admission ticket."
1.7 At the customer's request, a ticket may be refunded under the following conditions:
1.8 In the event of cancellation of the service, a refund will be issued within a maximum of thirty days, in accordance with applicable law.
1.9 In accordance with Law No. 2004-575 of June 21, 2004, Article L121-20-4 of the Consumer Code, the right of withdrawal specific to distance selling cannot be exercised (unless otherwise agreed by the parties) in the case of leisure services to be provided on a specific date or at specific intervals (such as tickets for shows). Furthermore, tickets cannot be refunded even in the event of loss or theft.
2.1 The albret-tourisme.com website provides real-time information on room availability. Reservations are also processed in real time.
2.2 Seating is unnumbered and generally "free" (see Article 3.1). The buyer will be informed of the possible existence of ticket categories corresponding to different sectors in the section presenting the event.
2.3 Online ticket sales for this event may be suspended even if it is not sold out.
3.1 The concept of "free seating" may be called into question by the organization if it is necessary to accommodate, control, and manage the flow of people differently. The Organizer reserves the right to manage the filling of the venue as it sees fit in the interests of optimal operation.
3.2 In the event of mandatory distancing (individuals or groups), the public would be asked to comply with the instructions of the seating teams responsible for optimizing capacity and comfort for everyone.
3.3 In the event of new capacity restrictions being imposed late and not matching/no longer matching sales already made, tickets would then be retained in order of booking. The new restrictions would, in fact, result in the cancellation of tickets and refunds for the last purchasers.
4.1 The Albret Tourist Office has entrusted the management of its payments/refunds to Vérifone, a service provider specializing in secure online payments, via its Paybox platform. The SSL protocol, a system for checking (the validity of access rights) and encrypting (data exchanges), secures and guarantees the complete confidentiality of the buyer's banking information during payment (see Verifone – Data Protection Regulation). However, the Albret Tourist Office, via its INGENIE invoicing software, collects the following data: surname, first name, email address, and telephone number. This data will be kept for 10 years.
4.2 The personal information provided by the buyer is used to process the transaction, ship the tickets (if applicable), and contact the buyer in the event that the event is canceled or in other cases of force majeure.
4.3 Depending on the amount of the order and as a security measure, additional information about the identity of the buyer and/or the holder of the credit card (IDCB) used for payment may be requested by email and/or telephone.
4.4 Buyers who wish to be kept informed, by mail and/or email, of news and offers from the Albret Tourist Office throughout the year may indicate this when placing their order. In accordance with current legislation, they have the option to unsubscribe from the Albret Tourist Office newsletter at any time.
4.5 In accordance with Article 34 of the French Data Protection Act of January 6, 1978, you have the right to access and rectify any data collected by contacting the Albret Tourist Office at accueil@albret-tourisme.com. In the event of a complaint that cannot be resolved directly with the Albret Tourist Office, the purchaser may contact the CNIL (https://www.cnil.fr/plaintes).
Personal data collected by the Albret tourist office when purchasing a ticket online is strictly reserved for use by the ticket office and for communication purposes regarding upcoming events. Addresses will be kept for a maximum of three years and will not be sold or disclosed to third parties.
As a reminder, in accordance with the GDPR, the Albret Tourist Office reserves the right to communicate—including to individuals who have opted out of receiving emails from it—within the framework of its legitimate interest in providing as much information as possible to ensure the smooth running of events.
5.1 Please note that an order for which payment has not yet been made is considered "pending" and does not constitute proof of a firm reservation. In this case, the order is considered final once payment for the tickets has been made. The buyer has a limited amount of time to confirm their order.
5.2 Confirmation of the order at the end of the process implies full and unreserved acceptance of the order and of these General Terms and Conditions of Sale (and, where applicable, any Specific Provisions applicable to the organizer).
5.3 Once payment has been completed, two emails will be sent to the buyer. The first serves as confirmation of the order and contains, where applicable, the link to access the electronic ticket(s). The second is the payment receipt. The data recorded by the ticketing server is authentic and constitutes proof of all transactions made.
The Albret Tourist Office cannot be held responsible for the possible reception of its emails in spam folders or for the blacklisting of its emails by the user's email provider.
5.4 Tickets can be:
– "printed at home" independently. In this case, no additional processing fees will be applied. An invoice made out to the purchaser is available on request.
– shipped within 7 days to the address provided online by the purchaser, with tracking, for a flat-rate processing fee of €4 per order. All tickets shipped by post will be accompanied by an invoice.
In addition to these General Terms and Conditions of Sale, the following special conditions apply to electronic tickets ("print-at-home" tickets). All you need to print electronic tickets is internet access and a standard printer.
6.1 The dematerialized ticket has a unique barcode and/or QR code. The validity of the ticket is checked and access to the site is recorded using barcode readers. The same ticket will only grant access to the venue once. Reproducing the ticket offers no advantage, as only the first holder of the electronic ticket will be admitted to the venue. The first holder is presumed to be the legitimate holder of the ticket. It is therefore prohibited to reproduce, duplicate, or counterfeit the ticket in any way, or to make it available to others for such purposes.
6.2 The purchaser is solely responsible for the use made of their electronic ticket. The organizer is not required to judge the authenticity of the electronic ticket if the imitation or copy cannot be identified as such with certainty during the access control. If the holder of a dematerialized ticket is refused entry for one of the reasons mentioned above, they have no recourse and no right to a refund of the price paid.
6.3 The buyer is required to keep their electronic ticket for the entire duration of their presence at the event venue.
6.4 To be valid, a dematerialized ticket must:
6.6 Any purchaser presenting a discounted ticket without being able to provide proof of eligibility will be denied access to the site without a refund or recourse and may face legal action.
7.1 In the event of cancellation, postponement, or interruption of the performance, any refund (excluding a processing fee) will be subject to the decision and sole conditions of the event organizer, in its capacity as the responsible party. If a performance is interrupted after more than half of it has taken place (force majeure), no refund will be issued. If postponed or modified, the purchaser is free to keep their ticket or request a refund. In this case, the Albret Tourist Office reserves the right to offer alternative options to the purchaser, who remains free to accept or decline them.
7.2 Except in exceptional circumstances (terms and conditions relating to the health situation), the purchaser, where applicable, is required to contact the agency that issued their ticket in order to claim their right to a refund.
7.3 In the event of cancellation, the refund (at the producer's discretion) of all tickets purchased online will be made to the purchaser by means of a transfer to their account upon receipt of their bank details. The right to a refund belongs exclusively to the purchaser. It is not transferable.
Unlike traditional tickets, e-tickets do not need to be returned in order to claim your rights.
In the case of cards that have expired between the date of purchase and the date of refund, such as prepaid cards or e-cards, as online refunds are no longer possible, the purchaser will be asked to provide their bank details in order to proceed.
A refund ticket (Paybox) is generated and automatically sent by email to the buyer for each online refund. This ticket serves as proof in the event of a dispute.
7.4 The buyer may, at any time, call 05 53 65 27 75 (no surcharge) to find out about any changes that may affect the evening.
For further information:
10.1 In accordance with current legislation (Law No. 2004-575 of June 21, 2004, Article L 121-20-3 of the Consumer Code), the Albret Tourist Office is fully liable to the consumer for the proper performance of the obligations arising from the distance contract.
10.2 The sale of tickets referred to in these general terms and conditions is subject to French law. In the event of a dispute, the French courts shall have sole jurisdiction.
The public institution OFFICE DE TOURISME DE L’ALBRET is authorized by the Abracada Vianne association to sell tickets for the festival.
